Terms of Use for Online Payments to the Narragansett Bay Commission


By using this website and any software therein (hereinafter the “Service”), you agree to abide by the Narragansett Bay Commission’s (hereinafter “NBC”) Rules and Regulations, all terms included within this Terms of Use agreement, and all applicable law with regard to your use of this website.  This Service is only intended for use by the NBC’s customers.  The NBC is not responsible for any unauthorized or unintended uses of the Service by individuals or entities who are not customers of the NBC.  To the extent that you authorize an individual or entity to use the Service on your behalf, the NBC must receive such authorization from you in writing.


Any payment that you make through the Service will be sent to the NBC for application to your account.  Late fees and/or other charges will be incurred on your account should you fail to make a payment when due.  The NBC reserves the right to reverse any payment you make to it. 


If you filed a petition in Federal Bankruptcy Court, your payment through the Service will be applied to your post-petition charges.  If your payment is in excess of the post-petition charges, the NBC reserves the right to apply any excess to your pre-petition amount unless law, court order, or an arrangement with the NBC requires otherwise.        


The NBC respects your privacy.  The NBC does not collect or hold sensitive personal information.  However, any private information delivered by you to the NBC will be secured and protected with at least the same degree of care that the NBC would protect its own confidential information and then such information received by the NBC will be destroyed.  The NBC will not be responsible for any unauthorized or unforeseeable use or misuse of your private information. Any information you transmit to a NBC vendor is the responsibility of the vendor and not of NBC.


By using this Service, you expressly consent to receive calls, text messages, e-mails, or any other electronic or manual communication from the NBC to any communication device you now currently own or may acquire in the future.  Communication devices include, but are not limited to: telephones, cellular telephones, smart phones, hand-held personal wireless communication devices, computers, or any communication technology yet to be conceived. You expressly consent to such communications being sent to any specific telephone number, facsimile number, e-mail address, or any electronic communication address to be developed in the future that you specifically provide to the NBC or that is discovered by the NBC.  You further expressly consent to such communications being live, automated, pre-recorded, interactive voice response, or any method developed in the future.  You are aware and agree that all such communications by the NBC could result in charges to you by the service provider for your communication device.  Please further be aware that any communications between you and the NBC may be recorded and you consent to all such recordings.  You may revoke this consent at any time by expressly informing the NBC through a communication that the NBC is able to receive.  The NBC assumes no liability for any failure to receive such revocation of consent from you.
